Seller Terms & Conditions

These Seller Terms & Conditions (βSeller Termsβ) apply to all sellers who register, list products, or sell products through the Damyaan marketplace.
By registering as a seller or using Damyaan's seller services, you agree to these Seller Terms.
1. Seller Eligibility
Sellers must provide accurate and complete information requested by Damyaan, including where applicable:
- Legal name/business name
- Contact details
- Business address
- Bank details
- PAN
- GST details, where applicable
- KYC documents
- Product information
- Other documents reasonably requested by Damyaan
Damyaan may verify seller information before or after onboarding.
2. Seller Account
Sellers are responsible for:
- Maintaining account security.
- Keeping information accurate.
- Protecting login credentials.
- All activities performed through their seller account.
A seller must not transfer or sell their seller account without authorization from Damyaan.
3. Product Listings
Sellers must provide accurate information about every product, including:
- Product name
- Description
- Images
- Specifications
- Price
- Stock availability
- Brand/manufacturer information where applicable
- Warranty information where applicable
- Applicable legal information
Misleading or false product information is prohibited.
4. Product Authenticity
Sellers must not list or sell counterfeit, fake, stolen, illegal, prohibited, unsafe, or unauthorized products.
Where applicable, sellers must be able to provide documents proving product authenticity or lawful sourcing.
Damyaan may request supporting documents at any time.
5. Prohibited Products
Sellers must not list products prohibited by:
- Applicable Indian law
- Government authorities
- Payment providers
- Logistics partners
- Damyaan policies
Damyaan may remove prohibited listings and take appropriate action against sellers.
6. Pricing
Sellers are responsible for maintaining accurate product prices.
Prices must not be misleading or deceptive.
Damyaan may take action against listings containing obvious pricing errors or misleading pricing practices.
7. Inventory
Sellers must maintain accurate inventory information.
Sellers should not accept orders for products that they do not reasonably expect to fulfil.
Repeated stock-related cancellations may result in seller restrictions.
8. Order Fulfilment
Sellers must process and dispatch orders within the applicable fulfilment timeframe communicated by Damyaan.
Sellers must:
- Pack products appropriately.
- Ship the correct product.
- Include required accessories.
- Provide applicable invoice/documentation.
- Use approved logistics processes where required.
9. Packaging
Products must be securely packaged to reduce the risk of damage during transportation.
Sellers may be responsible for losses caused by inadequate packaging where applicable.
10. Returns & Refunds
Sellers must comply with Damyaan's applicable Return & Refund Policy.
Sellers may be required to accept eligible returns, replacements, or refunds according to the applicable product policy and law.
11. Defective or Incorrect Products
If a seller sends:
- Wrong product
- Damaged product
- Defective product
- Incomplete product
- Product materially different from the listing
the seller may be responsible for the applicable resolution, subject to Damyaan's policies and applicable law.
12. Customer Information
Sellers may receive limited customer information necessary to fulfil orders and provide related services.
Sellers must:
- Use customer information only for legitimate order-related purposes.
- Keep customer information confidential.
- Not sell customer information.
- Not use customer information for unauthorized marketing.
- Not retain information longer than reasonably necessary or legally required.
13. Seller Fees and Payments
Applicable seller fees, commissions, payment processing fees, shipping charges, penalties, or other charges will be communicated through the seller agreement, seller dashboard, or applicable commercial terms.
Damyaan may deduct applicable amounts from seller settlements where permitted.
Seller settlement timelines may vary depending on order status, returns, refunds, chargebacks, disputes, and other applicable adjustments.
14. Taxes and Legal Compliance
Sellers are responsible for complying with applicable taxation and legal requirements relating to their business and products.
Where applicable, sellers must provide valid invoices and tax information.
15. Seller Performance
Damyaan may monitor seller performance based on factors such as:
- Order fulfilment
- Cancellation rate
- Return rate
- Customer complaints
- Product quality
- Dispatch performance
- Policy compliance
- Seller ratings
Poor or fraudulent performance may result in warnings, listing restrictions, temporary suspension, or termination.
16. Intellectual Property
Sellers must have the necessary rights to use product images, descriptions, trademarks, logos, and other content uploaded to Damyaan.
Sellers must not upload content that infringes third-party intellectual property rights.
17. Seller Indemnity
To the extent permitted by applicable law, sellers may be responsible for claims, losses, penalties, damages, or expenses arising from:
- Illegal products
- Counterfeit products
- Seller misconduct
- False product information
- Intellectual property infringement
- Violation of applicable law
- Breach of these Seller Terms
18. Suspension and Termination
Damyaan may suspend, restrict, delist, or terminate a seller account where reasonably necessary, including for:
- Fraud
- Counterfeit products
- Repeated policy violations
- Poor fulfilment
- Customer abuse
- False information
- Legal violations
- Security concerns
- Other serious misconduct
19. Changes to Seller Terms
Damyaan may update these Seller Terms from time to time.
Updated terms may be communicated through the seller dashboard, website, email, or other appropriate means.
20. Governing Law
These Seller Terms shall be governed by the laws of India.
Disputes shall be subject to the jurisdiction of courts having appropriate jurisdiction, subject to applicable law.
